I'm not sure whether they can or not in the UK but they should be allowed to do so if they wish no matter where they are.

inmates & donations

Post by Cheryl in CT »

Again, I think this question might need a bit of clarification. Should inmates donate? That depends. Here's my 2 cents:

Should inmates be ALLOWED to donate? yes... be FORCED or COERCED to do so? no!

In addition, I feel that ANY donations must be strictly altruistic, with absolutely no "extra" incentives or compensation (including reduction of time to be served) attached.

Complex

Post by JMan »

interesting one.. I beleive either China (not sure which) uses executed prisoners organs for transplant .. Obviously the need for 'consent' is negated there..

the obvious with a 'live' donation is that prisoners might 'potentially' develop later health problems as a result.. Lotta more complex issues around that one..

I think they should be able to give. I really don't see much issue here.

The law states that there is no compensation permitted and of course the Charter of Human Rights and Freedoms protects against prisoners (or anyone else) being coerced into anything that can risk their lives. Prisonners are protected under the law of the land to the same extent as the law-abiding folk. Hack'em up I say - but only if they're willing, of course.

Contrary to China, we don't execute people. I think, though, that the same principles should apply to these prisonners, they must consent. That said, in places where they do execute, I'm not sure they would bother with that.

i think they should be allowed to donate if they wish to do so, You cannot force any body to do any thing that they dont want 2 do. But with out sounding stereotypical many people who are in prison have used drugs in some way, still using drugs whilst they are still inside, so may this rule people out!!!

In principle it is a good idea. But it comes perilously close to fascist ideals. The same argument could be applied to people with mental illness, mental retardation, PVS, etc etc.

The very fact that the discussion is focused on prisoners implies that there has to be an element of coercion otherwise the whole argument would be superfluous. So, It all depends on the intrinsic value of a human life. If a prisoners life is worth less than someone else then yes its OK...

Saying all that when I was waiting for my transplant then I`d have said go for it!

I too think that they should be allowed to donate if they wish to and yes you cannot force any body to do any thing that they dont want to do. But with out sounding stereotypical many people who are in prison have used drugs in some way or may have or get aids, so may this rule people out.

If the test are done why cann't they...

That story is outrageous to me. That a common criminal would get a life saving organ before a criminal...that's foul.

death row transplant

Post by amanda in CA »

Giving a death row inmate a transplant above law-abiding citizens seems a terrible waste of an organ and tax-payers money. Furthermore, it can only harm the public's willingness to donate organs - how many of the general public would wish an organ of their loved to be donated to a murderer? Amanda

Should? no. Shouldn't? no. May? yes.

The question need to be revised to say "MAY prison inmates donate organs?" And my opinoin is yes, they can, just like everyone else. Nothing different about it. They should be able to recieve, and to give, just like everyone else. Regardless of what they are in prision for, I don't think they should be denied bc of that. However, if they are in prision for MURDERING someone, that may be an exception. Its really difficult. If someone robbed a house or stole a car too many times & is in prison, why shouldn't he get a tx? Why are yo better then him? bc you don't steal and do that sorta thing? I'm having a hard time with that. Bc you're both humans and living things.

However, in the case where someone clearly doesn't value human life, and kills somone.. thats different. Bc if he does't value someone elses life, I don't think he values his own. And if he deosn't value it, I don't think he should get an organ.

That's a HUGE topic of discussion, someothing i'm not going to get into now.

But as far as donating, I don't see a reason why the rules should be any differnet for them.
